END-USER AGREEMENT (EUA)
Effective Date: 20th December 2024
This End-User Agreement (the “Agreement”) governs your (“User”) access to and use of Susurate, a platform owned by The Social Collective Ltd (“We”, “Us”, “Our”). By accessing or using Susurate, you agree to the terms of this Agreement. If you do not agree, you may not access or use the platform.

1. PERMITTED USE
1. Data Submission:
• As a User, you are permitted to submit, manage, and interact with data on the platform as authorized by your organization or subscription plan.
• Data must be submitted accurately, completely, and in good faith. You are solely responsible for ensuring the correctness and integrity of all data you submit.
2. Compliance:
• You must use the platform in compliance with all applicable laws, this Agreement, and any instructions or policies provided by Susurate or your organization.
2. ACCURACY AND RESPONSIBILITY
1. Data Accuracy:
• Data submitted must be truthful and reflect accurate information. Misrepresentation or submission of false data is strictly prohibited.
• Data inaccuracies may result in the suspension of your access to the platform.
2. Responsibility for Use:
• You are responsible for all actions taken under your account. This includes ensuring that login credentials remain confidential and notifying your administrator of any unauthorized access or misuse.
3. SUPPORT AND SUBSCRIPTIONS
1. Limited Support:
• Basic platform guidance is available to all Users. For enhanced technical support or usage training, your organization must maintain an active subscription.
2. Subscription Requirement for Enhanced Use:
• Advanced platform features and extended support are available only to Subscribers. If your needs exceed the scope of the free access provided, you may start a subscription plan by contacting your administrator or directly reaching out to us.
4. DATA OWNERSHIP
1. Ownership:
• All data you submit remains the property of your organization (the Subscriber).
• De-identified and aggregated data may be used by Susurate for analytics and service improvements, as outlined in our Privacy Policy.
2. Data Responsibility:
• While we strive to ensure platform security, you are responsible for maintaining backup copies of any data submitted.
5. LIMITATIONS OF ACCESS
1. Account Suspension:
• If data submitted is found to be inaccurate, incomplete, or violates platform policies, your access may be suspended or terminated.
• Access to the platform is contingent upon the continued compliance of your organization with its subscription terms.
2. Unauthorized Use:
• Any attempt to misuse, reverse engineer, or exploit the platform for unintended purposes is prohibited and may result in immediate termination of access.
6. TERMINATION OF ACCESS
1. By the Organization:
• Your organization reserves the right to revoke your access to the platform at any time.
2. By Susurate:
• We may terminate your access if your organization’s subscription lapses or if you breach the terms of this Agreement.
3. Effect of Termination:
• Upon termination, your account will be disabled, and any remaining data may be transferred to your organization for safekeeping.
7. DISCLAIMERS AND LIMITATIONS OF LIABILITY
1. Platform Availability:
• Susurate is provided “as-is” and “as-available.” We do not guarantee uninterrupted access or error-free functionality.
2. Liability:
• To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the platform.
8. GENERAL TERMS
1. Changes to Agreement:
• We may revise this Agreement at any time. Continued use of the platform signifies acceptance of the updated terms.
2. Jurisdiction:
• This Agreement is governed by the laws of the Republic of South Africa.
